Dulux Academy Design & Decorate Challenge – Competition Terms & Conditions

1. The Promoter

1.1 The title of the competition is “Dulux Academy Design and Decorate Challenge.”

1.2 The promoter of this competition is: AkzoNobel of Wexham Road, Slough, Berkshire SL2 5DS (“we, us, our”)

2. The Competition

2.1 The title of the competition is “Dulux Academy Design and Decorate Challenge.”

2.2 Entrants to the competition are invited to submit their own design to the Dulux Academy, which will be judged by our expert panel and the winning entry printed onto an official roll of Dulux wallpaper (but not mass produced for public purchase).

3. How to enter

3.1 The competition will run from 10:00 AM on 25 August 2018 (the “Opening Date“) to 11:59 PM on 23 September 2018 (the “Closing Date“) inclusive.

3.2 All competition entries must be received by us at the address set out at condition 1 above by no later than 11:59 PM on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.

3.3 To enter the competition, simply send a completed entry form, which can be downloaded from our dedicated website at [LINK], together with your design to our address as set out in Condition 1.2 above by the Closing Date.

3.4 No purchase is necessary to enter the competition.

3.5 We will not accept:

a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

b) proof of posting or transmission as proof of receipt of entry to the competition.

3.6 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.8 The competition entries will be judged by a panel of four judges, with no more than 12 finalists proceeding to a public vote via our dedicated website. The winner will be determined on the basis of the public vote counting for 50% and the panel of judges also counting for 50% The decision of the panel of judges (acting reasonably) and the result of the public vote will be final.

3.9 The winner will be announced at an event that all finalists will attend to be held at the Dulux Academy (at the address set out in Condition 1 above) on 4 October 2018. The Judges are: Neil Ogilvy (PDA); Marianne Shillingford (Dulux Creative Director); Mark Rigby (Dulux Academy); and Louise Stevenson (Graham & Brown).

4. Eligibility

4.1 The competition is only open to professional decorators resident in the UK aged 18 years or over, except:

a) our employees or those of our holding or subsidiary companies;

b) our employees or agents or suppliers to us or our holding or subsidiary companies, who are professionally connected with the competition or its administration; or

c) members of the immediate families or households of (a) and (b) above.

4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. We may require you to provide proof that you are eligible to enter the competition.

4.3 We will not accept competition entries that are:

a) automatically generated by computer;

b) completed by third parties or in bulk;

c) illegible, have been altered, reconstructed, forged or tampered with;

d) photocopies and not originals; or

e) incomplete.

4.4 There is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.5 We reserve all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

4.6 Competition entries cannot be returned.

5. The prize

5.1 The prize will see the winner enjoy an luxury, overnight stay at the Dunkenhalgh Hotel and Spa with a meal for two to the value of £150, before seeing their design printed onto a roll of wallpaper courtesy of Graham & Brown. This will not be mass produced for public purchase.

5.2 The winner and all finalists will receive a Dulux Academy goody bag

5.3 There is no cash alternative for the prize, or for any finalist’s prize package.

5.4 The prize is not negotiable or transferable.

6. Winner announcement

6.1 The winner of the competition will be announced at the event described in clause 3.10 above on October 4 2018. (Announcement Date).

6.2 The public vote and the judges’ vote are final and no correspondence or discussion will be entered into.

6.3 We will contact finalists personally as soon as practicable after the Closing Date, using the telephone number or email address provided with the competition entry. We will not amend any contact information once the competition entry form has been submitted.

6.3 A list of winners can be viewed on our dedicated website, http://www.duluxacademy.online, for a period of 30 days after the Announcement Date.

7. Limitation of liability

7.1 Insofar as is permitted by law, AkzoNobel, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by our negligence or that of our agents, distributors or employees. Your statutory rights are not affected.

8. Ownership of competition entries and intellectual property rights

8.1 All competition entries and any accompanying material submitted to us will become our property on receipt and will not be returned.

8.2 By submitting your competition entry and any accompanying material, you agree to:

a) assign to us all your intellectual property rights, with full title guarantee; and

b) waive all moral rights,

in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

9. Data protection and publicity

9.1 We will only process your personal information as set out in our Privacy Policy. By entering the competition, you hereby confirm that we may use your name, photograph and any other Personal Data (as defined in the General Data Protection Regulation and Data Protection Act 2018) in relation to the administration of and any publicity relating to the Competition.

10. General

10.1 If there is any reason to believe that there has been a breach of these terms and conditions, we may, at our sole discretion, reserve the right to exclude you from participating in the competition.

10.2 We reserve the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

10.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
